บริษัท วีวิซ เดโม จำกัด (“บริษัท”) ดำเนินการเก็บข้อมูลการติดต่อกลับของผู้รายงานพฤติกรรมที่ไม่เหมาะสม/ละเมิดจริยธรรมที่สมัครใจให้ข้อมูล โดยบริษัทตระหนักถึงความสำคัญของการคุ้มครองข้อมูลส่วนบุคคล จึงต้องมีนโยบายคุ้มครองข้อมูลส่วนบุคคลนี้ เพื่อชี้แจงรายละเอียดและวิธีการจัดเก็บรวบรวม ใช้ และ/หรือเปิดเผย การคุ้มครองข้อมูล การเข้าถึงข้อมูล การโอนย้าย และการวิเคราะห์ประมวลผลข้อมูลส่วนบุคคลของท่าน ดังต่อไปนี้ นโยบายการคุ้มครองข้อมูลส่วนบุคคล (Privacy Policy) นี้อยู่ภายใต้พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 โดยบริษัทมีอำนาจหน้าที่ตัดสินใจเกี่ยวกับการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล ซึ่งตามกฎหมายเรียกว่า “ผู้ควบคุมข้อมูลส่วนบุคคล” ส่วนท่านถือเป็น “เจ้าของข้อมูลส่วนบุคคล” ตามกฎหมายนี้
บริษัทจะทำการเก็บรวบรวมข้อมูลส่วนบุคคลโดยมีวัดถุประสงค์ ขอบเขต และใช้วิธีการที่ชอบด้วยกฎหมายและเป็นธรรม โดยในการเก็บรวบรวมนั้นจะทำเพียงเท่าที่จำเป็นแก่การดำเนินงานภายใต้วัตถุประสงค์การเก็บข้อมูลติดต่อกลับ เพื่อแจ้งผลลัพธ์การตรวจสอบการรายงานการละเมิดพฤติกรรมละเมิดจริยธรรม/ไม่เหมาะสม เท่านั้น โดยดำเนินการภายใต้ความยินยอมของ “เจ้าของข้อมูลส่วนบุคคล” จากการขอความยินยอมโดยชัดแจ้งก่อนท่าการเก็บรวบรวม ใช้/หรือเปิดเผย
WeVis Demo Co., Ltd. (the “Company”) collects contact information from individuals who voluntarily report inappropriate or unethical behavior. The Company recognizes the importance of personal data protection and has therefore established this Privacy Policy to clarify the details and methods for collecting, using, and/or disclosing, protecting, accessing, transferring, and processing your personal data as follows. This Privacy Policy is governed by the Personal Data Protection Act B.E. 2562 (2019). The Company has the authority to make decisions regarding the collection, use, or disclosure of personal data, which is referred to by law as the “Data Controller.” You are regarded as the “Data Subject” under this law.
The company will collect personal data with a specific purpose, scope, and by lawful and fair means. The collection will be limited only to what is necessary for the operation under the objective of gathering contact information for the purpose of notifying the results of investigations into reports of unethical or inappropriate behavior. This will be conducted with the explicit consent of the “Data Subject,” obtained prior to the collection, use, and/or disclosure of such data.
1. ข้อมูลส่วนบุคคลที่เก็บรวบรวม ใช้ และ/หรือเปิดเผย
บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลในรูปแบบอีเมลสำหรับติดต่อกลับ โดยเป็นการให้ข้อมูลตามความสมัครใจของผู้ใช้งาน ซึ่งข้อมูลส่วนบุคคลนี้เป็นข้อมูลที่ทำให้สามารถระบุตัวตนของท่าน
2. วัดถุประสงค์ในการเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคล
บริษัทจะทําการเก็บรวบรวมหรือใช้ข้อมูลส่วนบุคคลของ “เจ้าของข้อมูลส่วนบุคคล” เพื่อประโยชน์ใน การแจ้งผลลัพธ์การตรวจสอบการรายงานพฤติกรรมที่ไม่เหมาะสมหรือการละเมิดจรรยาบรรณเท่านั้น หากภายหลังมีการเปลี่ยนแปลงวัตถุประสงค์ ทางเราจะแจ้งให้ท่านทราบ เพื่อขอความยินยอม ทั้งนี้จะไม่กระทำการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่าน เพื่อประโยชน์อย่างอื่น ที่นอกเหนือจากวัดถุประสงค์ที่ได้แจ้งไว้กับท่านไว้ก่อนหรือขณะเก็บรวบรวม
3. การเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคล
บริษัทจะไม่เก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลของท่านที่เกี่ยวกับเชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูล พันธุกรรม ข้อมูลชีวภาพ หรือข้อมูลอื่นใดซึ่งกระทบต่อท่านในทำนองเดียวกันตามประกาศของคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล โดยไม่ได้รับความยินยอมโดยชัดแจ้งจากท่าน เว้นแต่เป็นกรณีตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 มาตรา 26 บัญญัติให้กระทำได้
บริษัทจะเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลของท่านตามวัตถุประสงค์ที่ได้มีการแจ้งไว้ โดยจะไม่เก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลของท่านโดยปราศจากความยินยอมจากท่าน เว้นแต่เป็นข้อมูลของท่านที่เก็บรวบรวมได้โดยไม่ต้องขอความยินยอมตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 มาตรา 24 หรือมาตรา 26 และจะดำเนินเก็บรักษาข้อมูลส่วนบุคคลไว้เป็นความลับ
4. ระยะเวลาในการเก็บรวบรวม ใช้ และ/หรือเปิดเผยเข้อมูล
ข้อมูลจะถูกเก็บไว้ไม่เกิน 1 ปี นับจากวันที่ได้รับเรื่องร้องเรียน และจะถูกลบออกจากระบบเมื่อหมดความจำเป็น
5. การคุ้มครองข้อมูลส่วนบุคคล
บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลของท่านไว้เป็นอย่างดีดามมาตรการด้านการรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคลที่ สอดคล้องกับกฎหมาย ระเบียบ หลักเกณฑ์ และแนวปฏิบัติด้านการคุ้มครองข้อมูลส่วนบุคคล เพื่อป้องกันการละเมิดข้อมูลส่วนบุคคล การสูญหาย การเข้าถึง ท่าลาย ใช้ แปลง แก้ไข การนำข้อมูลไปใช้ หรือเปิดเผยข้อมูลนอกวัดถุประสงค์ หรือโดยไม่มีอำนาจหรือโดยไม่ชอบ
6. สิทธิของท่านเกี่ยวกับข้อมูลส่วนบุคคล
สิทธิของท่านในข้อนี้เป็นสิทธิตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 โดยท่านสามารถขอใช้สิทธิต่างๆ ได้ ภายใต้ข้อกำหนดของกฎหมาย ดังต่อไปนี้
- สิทธิในการขอถอนความยินยอม: ท่านมีสิทธิที่จะถอนความยินยอมเมื่อใดก็ได้ตลอดระยะเวลาที่ข้อมูลส่วนบุคคลของท่านอยู่ กับบริษัท ทั้งนี้การเพิกถอนความยินยอมย่อมไม่ส่งผลกระทบต่อเก็บรวบรวม ใช้ และ/หรือเปิดเผยข้อมูลส่วนบุคคลที่ได้ให้ความ ยินยอมไว้แล้ว
- สิทธิในการขอเข้าถึง ขอรับข้อมูลหรือสำเนาข้อมูล: ท่านมีสิทธิขอเข้าถึง หรือรับ ข้อมูลส่วนบุคคลของท่านเองที่อยู่ในความรับผิดชอบของบริษัท และขอให้บริษัททำสำเนาข้อมูลดังกล่าวให้แก่ท่าน รวมถึงขอให้เปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคลที่ท่าน ไม่ได้ให้ความยินยอมว่าได้ข้อมูลส่วนบุคคลของท่านมาได้อย่างไร
- สิทธิในการคัดค้าน: ท่านมีสิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของท่านเมื่อใดก็ได้ ในกรณีที่กฎหมายให้อ่านาจในการเก็บรวบรวมข้อมูลของท่านได้โดยไม่ต้องขอความยินยอมจากท่านก่อน
- สิทธิขอให้แก้ไขข้อมูล: ท่านมีสิทธิขอแก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้อง เป็นปัจจุบัน และไม่ก่อให้เกิดความเข้าใจผิด
- สิทธิขอให้ลบหรือทำลายข้อมูล: ท่านมีสิทธิขอลบหรือทำลายข้อมูลส่วนบุคคลของท่าน หรือทำให้ข้อมูลส่วนบุคคลเป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของได้
- สิทธิขอให้ระงับการใช้ข้อมูล: ท่านมีสิทธิขอให้บริษัทระงับการใช้ข้อมูลของท่าน เช่น เมื่อข้อมูลของท่านหมดความจำเป็นในการเก็บรักษาตามวัตถุประสงค์ในการเก็บรวบรวมข้อมูล
- สิทธิร้องเรียน: ท่านมีสิทธิร้องเรียนต่อผู้มีอำนาจตามกฎหมายที่เกี่ยวข้อง หากท่านเชื่อว่าการเก็บรวบรวม ใช้ และ/หรือ เปิดเผยข้อมูลส่วนบุคคลของท่านเป็นการกระทำในลักษณะที่ฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมายที่เกี่ยวข้อง
7. การเปลี่ยนแปลงนโยบายคุ้มครองข้อมูลส่วนบุคคล
บริษัทอาจปรับปรุงนโยบายส่วนบุคคลนี้เป็นครั้งคราว เพื่อให้สอดคล้องกับข้อกำหนดตามกฎหมาย การเปลี่ยนแปลงการดำเนินงานของบริษัท รวมถึงข้อเสนอแนะและความคิดเห็นจากท่าน โดยจะประกาศแจ้งการเปลี่ยนแปลงให้ทราบอย่างชัดเจนก่อนจะเริ่มดำเนินการเปลี่ยนแปลง

The Company will collect or use the personal data of the “Data Subject” solely for the purpose of notifying the results of investigations into reports of unethical or inappropriate behavior. If there is any change in purpose, we will inform you to obtain your consent. We will not collect, use, or disclose your personal data for any other purposes beyond those previously notified to you at or before the time of collection.
3. Collection, Use, and/or Disclosure of Personal Data
The Company will not collect, use, or disclose your personal data related to race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, criminal records, health information, disabilities, labor union membership, genetic data, biometric data, or any other data similarly sensitive as specified by the Personal Data Protection Committee, without your explicit consent—except as permitted under Section 26 of the Personal Data Protection Act B.E. 2562.
The Company will collect, use, and/or disclose your personal data only for the notified purposes and will not do so without your consent, except for data collected without consent according to Sections 24 or 26 of the Act. All personal data will be kept confidential.
4. Data Retention Period
Your data will be retained for no longer than 1 year from the date the complaint is received and will be deleted from the system once it is no longer necessary.
5. Personal Data Protection
The Comapany will safeguard your personal data with appropriate security measures in accordance with laws, regulations, standards, and best practices on personal data protection to prevent data breaches, loss, unauthorized access, destruction, use, alteration, or disclosure beyond the intended purposes or without proper authority.
6. Your Rights Regarding Personal Data
Under the PDPA, you have the following rights:
- Right to Withdraw Consent: You have the right to withdraw your consent at any time while your personal data is held by us. Withdrawal will not affect any collection, use, or disclosure of data that occurred prior to withdrawal.
- Right to Access and Obtain Copies: You have the right to access or receive your personal data held by us and request copies of such data. You may also request disclosure of how your personal data was obtained if you did not consent to its collection.
- Right to Object: You may object to the collection, use, or disclosure of your personal data at any time when the law allows collection without prior consent.
- Right to Rectify: You may request correction of your personal data to ensure it is accurate, current, and not misleading.
- Right to Erasure: You may request deletion or destruction of your personal data or request that it be anonymized so you cannot be identified.
- Right to Restrict Processing: You may request that we suspend the use of your data, for example, when it is no longer necessary for the purposes for which it was collected.

The Compant may update this Privacy Policy from time to time to comply with legal requirements, operational changes, or your suggestions and feedback. Any changes will be clearly announced before implementation.

By agreeing to this Privacy Policy, the Company will consider that you have accepted all terms and conditions, and such agreement is fully effective.
